Tony Moore July 1, 2011

From today, police now have the power to immediately suspend a driver who has a blood alcohol content of 0.1 or higher.

That is a decrease in the amount of alcohol in the bloodstream, down from 0.15, where police could previously suspend a driver’s licence until their appearance in court.

Transport Minister Annastacia Palaszczuk said the step was taken because drink drivers were involved in one-fifth of Queensland’s fatal road accidents.
Advertisement: Story continues below

Already, 117 Queenslanders have died on the roads this year, two more than for the same time as 2010.

The new laws, flagged last year, are designed to tackle the impact of drink drivers on road accidents on Queensland roads.

“In 2010, 50 people were killed as a result of crashes involving drink drivers,” Ms Palaszczuk said.

“This represents 20.1 per cent of all road fatalities in Queensland for that period.

“In the same year there were more than 29,000 drink driving offences detected in Queensland.”

The new legislation coming into effect from today also allows the arresting police officer to complete a breath test that will later provide the evidence in court.

Previously, a second police officer was always required for this phase of the test.

It also gives police three hours, up from two, to be able to complete a blood test to check for alcohol or drugs in a person’s bloodstream.

Ms Palaszczuk said drink driving laws were toughened following feedback on the Drink Driving Discussion Paper last year.

“More than 1000 online responses to the discussion paper were received by road safety experts and the members of the public,” she said.

“There was resounding support for the new laws with approximately 73 per cent of respondents supporting the lowering of the [blood alcohol content] suspension limit.”

Queensland road toll statistics show that of the 117 people who have died on Queensland roads this year, 44 were drivers; 30 were passengers; 23 were motorcycle riders or passengers; 17 were pedestrians; and three were cyclists or passengers on a push bike.

And of those 117 fatalities, 28 were killed in crashes involving a heavy freight vehicle.

In the past nine years, more than 700 people have died in traffic accidents in Queensland involving a drink driver.

If you’ve been caught drink driving on The Sunshine Coast, Gympie, Caboolture, Nambour or Noosa and would like to know what your options are in defending the charge or require a work licence then you should give Neil Whittle a call. He has many years experience defending these types of cases and will give you the advice you need. Call Neil on 0414 293 474

If you have been arrested for driving under the influence of alcohol and the breath test revealed you were over the blood alcohol concentration limit, you may think it would just be best to plead guilty; you may be mistaken. Before making any rash decisions concerning your alleged offence, consult a Susnhine Coast drink driving lawyer to discuss your case. There are often other legal aspects of your arrest that might be open for challenge.

DUI and Drink driving laws vary from state to state, and in some jurisdictions, the law requires suspects of driving under the influence to submit to a breath test or provide a blood sample as a means of accurately determining blood alcohol content, commonly referred to as your BAC. Refusal of these tests results in harsh penalties.

Even if the BAC results of a breath or blood sample are over the legal limit, Sunshine Coast DUI lawyers can sometimes challenge:

o The results of the test, and the testing procedure
o The collection, handling and storage of the sample, the time testing was carried out
o The manner in which other tests were conducted
o The arresting officer’s actions
o The cause for the traffic stop

If you have been arrested for driving under the influence, it is important to talk over the details of your case with a DUI lawyer. You may believe the case against you is all but settled, but your lawyer has plenty of experience in this area and may feel otherwise.

Neil is a Sunshine Coast drink driving and traffic lawyer passionate about handling your traffic and DUI defence, with ease, speed and professionalism. Trust your case to Neil your Sunshine Coast Drink Driving Lawyer
